OCM Excavation & Construction (“OCM,” “we,” “us,” “our”) respects your privacy. This Privacy Policy explains what information we collect, how we use it, who we share it with, and your rights under Canadian law including the Personal Information Protection and Electronic Documents Act (PIPEDA) and Canada’s Anti-Spam Legislation (CASL).

1. Who we are

  • Communications: emails, chat messages (via our Tawk.to live chat widget), call recordings (where legally permitted with disclosure).

3. How we use your information

  • Respond to quote requests and provide services you request.
  • Schedule on-site visits and coordinate project work.
  • Send invoices, receipts, and project updates.
  • Send marketing emails about our services only with your express consent (CASL-compliant). You can unsubscribe at any time.
  • Improve our website and services using anonymized analytics.
  • Comply with legal obligations and protect our legal rights.

4. Who we share your information with

We do not sell your personal information. We share limited information with:

  • Service providers who help us operate: web hosting via WordPress.com / Automattic; email via Google Workspace; analytics via Google; live chat via Tawk.to. Each is bound by their own privacy policies and confidentiality obligations.
  • Subcontractors who work on your project, only the project-specific information they need.
  • Law enforcement or regulators when required by law or to protect our legal rights.

5. How long we keep your information

Contact form submissions and project records are retained for 7 years (Ontario tax recordkeeping requirements). Analytics data is retained per Google’s default settings. Live chat transcripts are retained for 12 months. You can request earlier deletion (see Section 7).

6. Cookies and tracking

We use cookies and similar technologies to make the website work (essential), measure visitor behavior (Google Analytics 4 — anonymized), and provide live chat (Tawk.to). You can disable non-essential cookies via the consent banner displayed on first visit, or in your browser settings.

7. Your rights (under PIPEDA)

  • Access: request a copy of the personal information we hold about you.
  • Correction: request that we correct inaccurate information.
  • Deletion: request that we delete your information (subject to legal retention requirements).
  • Withdraw consent: at any time for non-essential processing (e.g., unsubscribe from marketing).
  • Complain: to the Office of the Privacy Commissioner of Canada at priv.gc.ca.

We may update this Privacy Policy. The “Last updated” date at the top reflects when changes were made. Material changes are announced at the top of this page.
